A Hawaii County ordinance raising the legal age to buy tobacco products to 21 goes into effect in less than a week and Big Island retailers are gearing up to comply with the new law. He said a survey of tenants showed 80 percent favor restrictions. Health concerns drove his decision, especially exposure to second-hand smoke. Safety was another reason. And cleaning costs waste taxpayer money. "It takes an average of $3,700 more to get a smoking unit ready versus non-smoking," he said.

Smoking would be illegal in any motor vehicle occupied by someone less than 18 years old, according to the bill from Puna Councilwoman Emily Naeole-Beason.

The ban is to protect kids, said Naeole-Beason, who has often credited her children for helping her quit smoking.

The measure now goes to Mayor Billy Kenoi, who may choose to sign it into law, allow it to take effect without his approval or veto it.

Kenoi told the Tribune-Herald that he supports the bill's intent of protecting children's health and safety.

With a cigar smoldering and the smoke wafting throughout, O'Toole's Irish Pub doesn't hide the fact it serves smokers.

"I'm okay with that. I'm not proud of it. I'm just okay with it. It's an economic reality," said Bill Comerford, President of E&J Lounge Operating Co. which runs O'Toole's, Kelley O'Neil's and the Irish Rose Saloon.

Three years ago the state passed the no smoking bill prohibiting smoking indoors and within 20 feet of an entrance. Yet Comerford allows smoking at all three of his bars because he says it's up to police to enforce the law, not him.

Comerford says he's still in compliance with law because he's placed the no smoking signs and stickers throughout his establishments and his employees advise the customers there is no smoking. But he also provides customers with an ash tray. So doesn't that send a mixed message?

They want state lawmakers to allow bars to pay an annual fee starting at $1,000 to allow smoking in their establishments.

Only stand-alone bars -- not restaurants -- would be able to apply for the exemption.

Proposals to create exemptions from the state's workplace smoking ban have been introduced in each of the past three years since the ban took effect, but all of them died in the Legislature.

Hawaii's smoking rate has declined dramatically since 2000 and the American Cancer Society hopes to continue that trend as the 34th Great American Smokeout is observed today.

Hawaii lawmakers will consider a bill Tuesday that would prohibit lighting up cigarettes on world-famous Waikiki Beach.

State law already prohibits smoking in all enclosed and partially enclosed workplaces and public places, including restaurants and bars.

The law has been opposed by some bar and restaurant owners who say it has hurt business, although anti-tobacco groups say it has had the opposite effect.

House Bill 1509 would prohibit smoking on the beaches of Waikiki from the shore break to the sidewalk of private property lines.

Smokers who light up in a non-smoking hotel room in Hawai'i may may find themselves paying several hundred dollars more for the room cleanup.

Travel Hawaii, a Hawai'i-based Internet retailer, has set up a database -- www.travel-Hawaii.com/smoking.html -- that details the smoking policies of hotels throughout the state.

Travel Hawaii owner John Lindelow said his company updates the information as policies shift. "This is a rapidly changing area of hotel policy, so we make a lot of phone calls to stay on top of what the hotels are doing," he said.

So far, the top charge goes to Aqua Palms & Spa in Waikiki, with a $500 fee to clean a smoke-free room there.

Hawaii Hotel & Condominium Smoking Policies

In November of 2006, the state of Hawaii instituted a strict new smoking law. As a result, many Hawaii hotels declared all of their guest rooms to be smoke-free. This has been a boon to non-smokers, of course, who no longer have to enter a hotel room with that telltale odor of "smokers past" lingering in the air. However, smokers aren't happy with such policies, as they won't be able to stay at smoke-free hotels unless they stash their habit for the length of their stay, or only smoke "off premises" or in designated areas, which are usually outside any public area in the hotel, e.g. places like parking lots and other outside areas that are at least 20 feet from any doors or windows.

Some entire Hawaii hotel chains have declared all of their rooms to be smoke-free. These include:

* Outrigger and OHANA Hotels Hawaii

* ResortQuest Hotels Hawaii

* Marriott Resorts Hawaii
