Atlantic City's "smoke and mirrors" casino ordinance, which mandates a 75-25 split on the gaming floors of casinos, is proving as ineffective and dangerous as advocates warned. Casino employees allege that secondhand smoke exposure conditions have become even worse since the ordinance's implementation on April 15, 2007. New Jersey GASP tested the air in casinos in Rhode Island, where state law requires separately walled and ventilated sections, as does the Atlantic City ordinance. The testing showed that, as smoking was concentrated into smaller areas, the level of pollution increased. Casinos are workplaces. The video series will contain interviews with casino employees, advocates, researchers and elected officials as they share their perspective on why casinos must be 100% smokefree.

Policymakers hear the message that all workers deserve equal protection from secondhand smoke while on the job and are proceeding forward to close the loophole left by the 2006 New Jersey Smokefree Air Act, which made most workplaces in New Jersey 100% smokefree, including factories, offices, government buildings, restaurants, and bars. In July 2007, the Senate unanimously passed (35-0) Senate Bill 1089, which amends the Smokefree Air Act to remove the exemption for casinos floors and simulcasting facilities. S1089 now moves onto the Assembly.

Smokefree college residence halls
New Jersey has the strongest smokefree college law in the country. In August 2005, then-acting Governor Richard Codey signed a bill that makes all residence halls on all New Jersey college campuses, both public and private, 100% smokefree as of October 2005.

New Jersey lawmakers advanced a bill last week that would ban smoking at all state and municipal beaches and parks. Its already forbidden inside most public areas and workplaces and some municipal beaches. Were all for reducing the publics exposure to secondhand smoke and keeping beaches cleaner discarded cigarette butts are a significant problem. The New Jersey Sierra Club estimated that tens of thousands of them are picked up during annual beach cleanups.

But for the Revel Casino Hotel in Atlantic City, that term may actually signal that the current owners are deciding exactly how they want to fold their hand. According to numerous reports, the current Revel owners (a group led by Chatham Asset Management) are pursuing those strategic alternatives when it comes to the struggling casino. In the world of the gaming industry, that phrase rarely means anything good, with common results being that a venue is being shopped around for sale or that the company is considering filing for Chapter 13 bankruptcy. But the Revel didnt come out of that bankruptcy restructuring all that well, despite the best efforts of management. The casino received some bad press after they attempted to draw in customers with a cant lose slots promotion that promised gamblers their money back if they lost on the machines. But players were disappointed to find out that they wouldnt receive their losses back in cash or as credit they could use at any time; instead, they were allowed to receive credit on future visits, a few percents at a time, and only by coming on specified weeks after the promotion ended. Still, promotions like that one could signal a shift in the Revels strategy. Once envisioned as a non-smoking luxury resort for high-end gamblers, there are signs that the casino is willing to open up its customer base to a broader range of customers, including those on a budget and, of course, smokers. Just a day before their statement on the potential use of strategic alternatives, Revel had a much less prominent press release that pointed out their low-cost dining alternatives, including a $3.99 breakfast deal.

The Student Government Associations vote to extend the 25-foot smoking ban to apply to all buildings on campus seems like a good idea. Preventing smoking promotes healthy bodies and a healthy environment. This ban would extend the distance between smoker and building, which also decreases the risk of fire and the chance of smoke getting through the front passageways.
These are all advantages, but how easily could this be enforced?

But she ran into some opposition she had never considered: smoking golfers. Gialanella proposed a ban on smoking on public grounds like the municipal building, and in parks and recreation areas, including Scotch Hills Country Club, a township-owned golf course. But when the ordinance was scheduled to be formally introduced at Tuesdays council meetings, all three members of the township council voted to delay it, saying they were concerned the ban would keep golfers from enjoying a cigar while hitting the links. I was very frustrated with the other members of the council, Gialanella said in a phone interview. People would be blown out of the water if they had any idea how long it takes for the council to accomplish what she calls common sense measures.

The resort has not submitted plans showing how it would add a designated smoking area to the casino floor — blueprint submissions are required of any property prior to adding a smoking section, according to the Atlantic City Health Department. Under the city’s health codes, a casino can add smoking areas, but the space must encompass no more than 25 percent of the gambling floor. … “As we evaluate our business model and look for ways to improve the long-term viability of Revel, we are carefully weighing the benefits of and how best to introduce a designated smoking area within the casino,” he said. “We aim to provide a wide array of amenities in order to cater to our guests’ varying preferences, and a designated smoking area could further add to this offering.” The decision to add a smoking area is a difficult one because Revel, which was built on a model that promotes healthy living, stands to alienate patrons drawn to the resort for its smoke-free environment, some observers said. “You would have to weigh the upside with the potential loss you might experience from visitors who want a resort experience that is smoke-free,” said Israel Posner, executive director of the Lloyd D. Levenson Institute of Gaming, Hospitality and Tourism at Richard Stockton College. …

The folks at Revel Atlantic City made a series of blunders that left the $2.4 billion casino filing for Chapter 11 reorganization in U.S. Bankruptcy Court less than a year after the doors were opened last May. But one that perhaps did not have to be on the list was the no-smoking policy – one that Revel executives are now reconsidering. I found this “gamble” intriguing, because there seemed to be an opportunity to lure in more high-roller non-smokers than it drove away high-rollers smokers. But as the article notes, this approach has to be marketed aggressively. Why? Because smokers find out rather quickly that they can’t smoke on the grounds – and many then don’t return. But the non-smokers staying at other casinos in the city likely have no idea about Revel’s policy – a marketing miss, because some of those people would be more likely to stay at Revel (or at least visit for shopping, drinking and dining). …

But Revel is wrong to think that allowing smoking will bring in more business. If anything, it will drive away customers who care about their health. The Wall Street Journal reported that Revel has privately told investors that smoking is under consideration. “I can’t confirm any information on whether or not we are considering smoking,” Siman said, declining further comment. Revel is the only Atlantic City casino that bans smoking. Anti-smoking advocates are alarmed at the possibility that Revel may reverse its policy. …

The ordinance, which passed unanimously on the second reading after the public hearing, prohibits the use and disposal of cigarettes or other tobacco products within 50 feet of any park, playground or recreation area that the borough owns, leases or utilizes. This includes the property around Borough Hall and the Library of the Chathams.

MONTGOMERY — The township is not banning smoking on all municipal property.

Such was the consensus at the Township Committee’s Thursday meeting, when Republican Mayor Mark Caliguire said the ordinance the committee introduced at its previous meeting went beyond what he had intended.

The ban was unanimously introduced without comment at the committee’s Oct. 7 meeting. But last week Mayor Caliguire said he had originally intended the ban as a way to stop township employees who smoke from getting more breaks than nonsmoking municipal workers.

That intention, he said, got lost in translation when it was written into an ordinance.

”As much as I hate smoking and I hate smoking in public places; I’m not sure if it’s something where we want to take the big step of banning it completely,” he said.

Councilman Dennis Mason announced Wednesday that the city will not continue discussions about outlawing smoking in local gaming halls until the end of 2011, a decision made in private after a councilman who supports a full ban was barred from the debate.

Mason said the decision was made at council’s recent Revenue and Finance Committee meeting, along with other conversations held in executive session.

TRENTON -- Electronic cigarettes look like the real thing. And in New Jersey, lawmakers want to treat them the same way.

That's why the Assembly voted unanimously Monday to ban the sale of e-cigarettes to people under 19, and prohibit adults from smoking them at work and in public places.

The Senate Health, Human Services and Senior Citizens Committee also gave unanimous backing to the legislation.

E-cigarettes look like the actual cigarettes but don't contain tobacco. A metal tube with a battery heats up a nicotine solution allowing smokers to breathe in vapor. They have not been approved by the Food and Drug Administration, which in July issued an advisory the devices contain carcinogens and toxic chemicals such as diethylene glycol, an ingredient used in antifreeze.

Assemblywoman Connie Wagner (D-Bergen), a sponsor, said she's concerned e-cigarettes are being marketed to children because they offer flavors like chocolate, banana and strawberry and could serve as a gateway to real cigarette use. ...

ATLANTIC CITY - The city official who was among the most vocal supporters of a resort-wide smoking ban now wants it off the table.

There is a bizarre stance being taken by Councilman Dennis Mason when it comes to smoking in Atlantic City. Mason believes that AC casinos should protect their residents from the dangers of second hand smoke, but only if neighboring states take the initiative on the matter.

"I'll be happy to support a 100 percent smoking ban if and when casinos in other states enact the same thing," said Mason, "All we want to be on is equal footing."

So this is what the smoking issue has come down to in Atlantic City. The gaming industry is so strong in the city, that Councilman Mason openly admits that he has no real stance on the dangers of second-hand smoke. The only issue Mason is concerned with is a financial one.

Mason, however, is not alone with his lunacy on the smoking issue. The entire City Council is split on whether protecting patrons and workers from second hand smoke is as important as the financial ramifications should the casinos lose some customers.

Last year, the Council voted 5-4 to delay implementation of a smoking ban in casinos and used the economy as their crutch for giving in to the gaming industry. This year, however, the Council will not receive a free pass from workers and AC residents more worried with their health than the casinos' bottom line. ...

DePierro, a New Yorker, settles into her cigarettes-and-slots routine whenever she comes to Atlantic City and dreads the thought that her gambling pleasures may someday be interrupted by a casino smoking ban.

"Smoke in taxis" flashes across a flat-screen television at the unambiguously named Smoking Everywhere kiosks. "Smoke at sporting events. Smoke at the movies. Smoke at the office."

To bring the message home, a salesman at Westfield Garden State Plaza took a drag and blew three perfectly formed rings toward shoppers strolling out of J.C. Penney.

According to the product's marketers, that substance may look like cigarette smoke, but it's as harmless as water vapor. It's almost completely odorless, they say, and it dissipates in seconds.

But some North Jersey health officials aren't convinced.

Buoyed by a recent Federal Drug Administration study that found electronic cigarettes may contain carcinogens and toxic chemicals -- including diethylene glycol, a substance found in antifreeze -- state and local officials have issued warnings about using them or leaving them where they can be reached by children.

Paramus health officials said they are alarmed by reports of people using electronic cigarettes at Westfield Garden State Plaza and are considering a ban on the use of e-cigarettes in indoor public places or work environments, just like regular cigarettes. It would be one of the first bans of its kind in the country.

"The safety of these things cannot be assured," said Paramus Health Department Director John Hopper. "Our concern is the effect to the non-smoking public who may be breathing the vapors of these things -- because they do give off vapors -- in public places." . . .

Darnell White, who owns Smoking Everywhere franchises at the Westfield Garden State Plaza and Palisades Center malls and sells electronic cigarettes online at smokingeverywhere.biz, defended his company, saying it refuses to sell to children under 18 and claiming the product keeps people from smoking traditional cigarettes.

"Anything that gets people away from regular cigarettes is a plus in my book," said White, himself a non-smoker. "At the end of the day, this product has helped hundreds of people to stop smoking." . . .

But smokeless cigarette distributors say the agency has overstepped its authority. Smoking Everywhere sued the FDA in April after the agency seized several of its shipments.

As for Paramus' possible smoking ban, White says he won't let it pass without a fight.

"The name of the company is Smoking Everywhere," he said. "Everywhere means the malls also."

Citing studies that document the health risks to non-smokers who are exposed to secondhand smoke, as well as environmental concerns, Sen. Barbara Buono (D-Middlesex) said today she is introducing a bill to ban smoking at all state, county and municipal parks and beaches.

“While cigarette smoking has declined dramatically since the first Surgeon General’s report more than 40 years ago, tobacco continues to take a deadly toll,” Sen. Buono said. “A report on tobacco use in America by the Institute of Medicine of the National Academies found that among the 440,000 annual deaths caused by tobacco are 50,000 non-smokers killed by the smoking of others.” ...

Bradley Beach officials have now said they will probably not ban smoking east of Ocean Avenue as was originally considered.

Instead, the Borough Council is looking at smoking areas designated along the beachfront after residents and council members alike said they had second thoughts about implementing a total ban.

SEASIDE HEIGHTS -- After nearly a year of considering options, the borough this week unveiled no-smoking sections on the beaches.

The borough adopted an ordinance at the end of 2008 giving the council the authority to designate no-smoking zones, Borough Administrator John Camera said. In June, the council set rules that allow smokers to remain in the 20 feet closest to the boardwalk, but the rest of the beach is designated as nonsmoking.

"It seems like a pretty good compromise. We don't want to turn anyone away," Camera said, adding that the governing body considered many different options to balance the needs of smokers and nonsmokers.
"They have already received some concerns from residents that it's not enough of an area, or it's not being enforced enough," he said. ...

New Jersey's campaign finance system may have restricted the flow of big money into statewide elections and cut down on the abuses known as pay to play, but determined donors and fund-raisers always seem to find a loophole.

Indeed, newly available records show that big donors to the Democratic and Republican Parties -- along with law firms, engineers and others who do business with the state -- are sidestepping the state's contribution limits and pay-to-play rules by giving to the parties' governors' associations, which turn around and spend heavily in New Jersey.

Harry Pozycki, chairman of the Citizens' Campaign, a nonpartisan group that is an advocate of the pay-to-play rules, said on Monday that the two associations were providing "a huge back door for the evasion of contribution limits." He added, "Following the money becomes that much more difficult." . . .

The Republican Governors Association, which has spent nearly $3 million already in support of Christopher J. Christie, the former federal prosecutor who is challenging Mr. Corzine, has raised $90,000 from the National Rifle Association since December. . . .

Big tobacco also seems to be backing Mr. Christie, who as a securities lawyer once represented the industry in an antismoking lawsuit: Tobacco interests have given the Republican group nearly $300,000. ...

Smoking ban bylaw approved

If you plan on lighting up a smoke, or something else within 25-metres of a playground structure or sports field in Quinte West, forget it.

City council approved a second major bylaw Monday night that extends a city-wide smoking ban in public places.

In June, politicians banned smoking within nine metres of entrances and exits to municipally-owned buildings.

But the anti-smoking legislation didn’t get unanimous support.

Trenton ward councillor Doug Whitney, a self-confessed smoker, said wording in the bylaw was too restrictive.

“It’s also too hard to enforce and with the current wording it would apply to all of Centennial Park,’’ he said.

Whitney said the bylaw as written didn’t exclude areas of city-owned parks where there is no playground apparatus or sports fields. ...

Cigarette breaks on the beach here are about to get more complicated.
Already known as the first beach in the continental United States to limit smoking to designated areas -- under a law passed in 2001 -- Belmar now plans to limit those areas even further, the Township Council announced today.

Until now, smokers were allowed to light up within 100 feet of smoking signs that stood every 400 feet along the beach. All told, 20 percent of the beach was set aside for smoking, enough to allow smokers to set up their chairs within the designated areas.

But beginning this beach season, each smoking area will shrink significantly, some to as small as 20 by 30 feet. Smokers will need to walk to the designated areas every time they feel an urge to puff.
And, unlike before, the boundaries of the smoking areas will be delineated by a plastic chain or a rope, to make enforcement easier. ...

More Rules For Minors Mulled In Frenchtown

FRENCHTOWN -- In the wake of vandalism at the Frenchtown Cemetery, in which several dozen headstones were damaged, Councilman Brad Myhre wants an early start to the borough's usual summer 10 p.m.-6 a.m. curfew for minors. He planned to bring the matter up at last night's Borough Council meeting.

Problems associated with young people loitering in Borough Park have been reduced with increased police foot patrols, he said. Mr. Myhre, who serves as police commissioner, added that he would prepare an ordinance to discourage loitering even further by banning all smoking in public parks and playgrounds.

The borough might also want to consider prohibiting smoking by juveniles in all public places, a step already taken by Clinton, he said. ...

12 months later, smoking ban no longer hot topic in Atlantic City

The state's dire economic situation was not as evident a year ago. That might have been why Atlantic City council members voted unanimously to ban smoking entirely in all resort casinos on April 23, 2008.

Since then, the tanking economy has given casino executives a strong argument to delay the full ban. Smoking opponents had their brief day in the sun, but when it came time for the city to pull the trigger on their legislation, resort government balked. On Oct. 8, council voted 5-4 to delay implementing the smoking ban.

"Now is the wrong time," Mark Juliano, chief executive officer of Trump Entertainment Resorts Inc., told council before its vote to delay the ban. "Timing is the issue. Not whether to implement (the restrictions), but when to do so."

Council's delay will continue at least until October. However, discussion of the ban has ceased entirely among council members since its deadline was extended.

Meanwhile, nonsmoking advocates are turning to the state for a solution.
State legislators recently discussed the loophole in the New Jersey Smoke-Free Air Act that allows casino smoking. A panel of lawmakers heard testimony from both sides but did not hold a vote to close the loophole. ...

ATLANTIC CITY, N.J. - New Jersey is thinking of doing what Atlantic City has been unable or unwilling to do: impose a total smoking ban on all 11 casinos.

A state senate committee is considering a bill to remove the casino exemption to the statewide smoking ban in public places.

Casino workers and anti-smoking advocates testified Tuesday that dealers and casino floor workers deserve the same protections as any other worker.

TRENTON - State lawmakers will discuss a bill next week that would close the loophole that allows smoking on casino floors and simulcasting facilities.
The Senate Health, Human Services and Senior Citizens Com-mittee will take testimony on the bill at its session here, scheduled for 1 p.m. March 2 in Committee Room 1 in the State House complex.

Committee Chairman Sen. Joseph Vitale said no vote was scheduled and that the committee wants to hear what opponents of a smoking ban have to say.

"I think it's necessary to have a real public discussion about this issue," said Vitale, D-Middlesex, who in previously supporting a wider ban testified on the issue in front of Atlantic City's City Council.

The New Jersey Smoke-free Air Act went into effect April 15, 2006, banning smoke in most public places outside of cigar bars and other similar tobacco-related businesses.

At Wednesday's Board of Commissioners meeting, Commissioner Anthony Deely placed a beach smoking ban on the table. Deely cited protection of children as a reason for the proposed ordinance.

"You can excuse yourself from the beach and go to the street ends and smoke," Deely said.

Deely proposed that the smoking ban be in effect while lifeguards patrol, from 9 a.m. to 5 p.m. daily.

ATLANTIC CITY (AP) — Smoking will be permitted again in the city’s 11 casinos for at least the next year, as the City Council voted Monday night to overturn a temporary smoking ban that took effect 12 days ago.

Before a packed chamber of casino workers and nonsmoking advocates, council's nine members voted for an ordinance that will clear the smoke on all city gaming floors by Oct. 15. The measure does allow casinos to build separately ventilated smoking rooms that cannot require personnel.

"There's an industry out here that we have a responsibility to," said Councilman Bruce Ward, a driving force behind the legislation. "But we also have a responsibility to our visitors and our workers."

The results from the 2006 NJYTS identify areas of significant progress in tobacco control for the state of New Jersey. Since 1999, the prevalence of lifetime use of any tobacco product decreased by 15.6% among middle school students and by 16.8% among high school students. Also, since 1999, current tobacco use decreased by 10.5% and 14.4% among middle school and high school students, respectively. Current cigarette smoking prevalence also decreased dramatically between 1999 and 2006; current smoking decreased by 7.3% among middle school students and 11.8% among high school students. The prevalence of current smoking among high school students is now estimated to be 15.8%, making New Jersey well situated to reach its Healthy NJ 2010 target to reduce high school cigarette smoking prevalence to 15%.

Cancer-Stricken Casino Worker Sues Over Secondhand Smoke

In a suit filed July 10, a Tropicana Casino & Resort employee claims that his lung cancer was caused by 25 years of involuntarily inhaling other people's smoke on the casino floors.

The litigation came just after U.S. Surgeon General Richard Carmona released a report finding that nonsmokers exposed to "environmental tobacco smoke" have a 20 percent to 30 percent greater risk of contracting heart disease and lung cancer.

By adopting the Smoke-Free Fair Act, effective April 15, New Jersey became one of 11 states to ban smoking in indoor public places…

Casino gaming areas were exempted from the New Jersey law because of strong pressure from southern New Jersey legislators who cited industry fears of a major falloff in revenues.
