smoking in Atlantic City's casinos and market resort as a breath ...
Press of Atlantic City - February 10, 2014
I recently returned from a weeklong vacation in Las Vegas. I enjoyed
the 60-something temperatures while the East Coast was mired in a deep
freeze, visited with friends and family, ate wonderful meals, and even
left with some of the casinos' money. But I also came home with a respiratory
infection and a suitcase full of clothing that had to go right into
the washing machine because it reeked of stale tobacco. Las Vegas has
very few smoke-free gaming areas, and I sure could smell the difference.
It all got me thinking about Atlantic City's decline in gaming revenues.
One solution for Atlantic City would be to make the resort's casinos
entirely smoke-free and then market the daylights out of that fact.
Given that 82 percent of American adults are non-smokers, I think it

City's Revel Casino Considering Strategic Alternatives
Casino.Org News - November 14, 2013
When most gamblers think about strategic alternatives, theyre considering
whether to raise or call at the poker table. But for the Revel Casino
Hotel in Atlantic City, that term may actually signal that the current
owners are deciding exactly how they want to fold their hand. According
to numerous reports, the current Revel owners (a group led by Chatham
Asset Management) are pursuing those strategic alternatives when it
comes to the struggling casino. In the world of the gaming industry,
that phrase rarely means anything good, with common results being that
a venue is being shopped around for sale or that the company is considering
filing for Chapter 13 bankruptcy. But the Revel didnt come out of that
bankruptcy restructuring all that well, despite the best efforts of
management. The casino received some bad press after they attempted
to draw in customers with a cant lose slots promotion that promised
gamblers their money back if they lost on the machines. But players
were disappointed to find out that they wouldnt receive their losses
back in cash or as credit they could use at any time; instead, they
were allowed to receive credit on future visits, a few percents at a
time, and only by coming on specified weeks after the promotion ended.
Still, promotions like that one could signal a shift in the Revels strategy.
Once envisioned as a non-smoking luxury resort for high-end gamblers,
there are signs that the casino is willing to open up its customer base
to a broader range of customers, including those on a budget and, of
course, smokers. Just a day before their statement on the potential
use of strategic alternatives, Revel had a much less prominent press
release that pointed out their low-cost dining alternatives, including
a $3.99 breakfast deal.

The Student Government Associations vote to extend the 25-foot smoking

E-cigarettes are battery-operated devices that contain cartridges filled

states when it comes to regulating the devices, particularly when it

New concerns over the proposal to ban outdoor smoking on all publicly-owned

The Star-Ledger - May 26, 2013
As Colleen Gialanella played with her 3-year-old son around the outskirts
of a Scotch Plains soccer field earlier this spring, she was dismayed
by the number of cigarette butts littering the ground. So she decided
to do something about it and, being deputy mayor, she thought she could.
But she ran into some opposition she had never considered: smoking golfers.
Gialanella proposed a ban on smoking on public grounds like the municipal
building, and in parks and recreation areas, including Scotch Hills
Country Club, a township-owned golf course. But when the ordinance was
scheduled to be formally introduced at Tuesdays council meetings, all
three members of the township council voted to delay it, saying they
were concerned the ban would keep golfers from enjoying a cigar while
hitting the links. I was very frustrated with the other members of the
council, Gialanella said in a phone interview. People would be blown
out of the water if they had any idea how long it takes for the council
to accomplish what she calls common sense measures.

considers adding smoking section to casino floor
Press of Atlantic City - April 14, 2013
Revel bankruptcy documents say the Atlantic City megaresort intends
to add a smoking section as part of its restructuring changes, but there
are indications officials havent made a definitive decision. The
resort has not submitted plans showing how it would add a designated
smoking area to the casino floor blueprint submissions are required
of any property prior to adding a smoking section, according to the
Atlantic City Health Department. Under the citys health codes,
a casino can add smoking areas, but the space must encompass no more
than 25 percent of the gambling floor.
As we evaluate our
business model and look for ways to improve the long-term viability
of Revel, we are carefully weighing the benefits of and how best to
introduce a designated smoking area within the casino, he said.
We aim to provide a wide array of amenities in order to cater
to our guests varying preferences, and a designated smoking area
could further add to this offering. The decision to add a smoking
area is a difficult one because Revel, which was built on a model that
promotes healthy living, stands to alienate patrons drawn to the resort
for its smoke-free environment, some observers said. You would
have to weigh the upside with the potential loss you might experience
from visitors who want a resort experience that is smoke-free,
said Israel Posner, executive director of the Lloyd D. Levenson Institute
of Gaming, Hospitality and Tourism at Richard Stockton College.
casino policy may go up in smoke
NorthJersey.com (blog) - April 14, 2013
The folks at Revel Atlantic City made a series of blunders that left
the $2.4 billion casino filing for Chapter 11 reorganization in U.S.
Bankruptcy Court less than a year after the doors were opened last May.
But one that perhaps did not have to be on the list was the no-smoking
policy one that Revel executives are now reconsidering. I found
this gamble intriguing, because there seemed to be an opportunity
to lure in more high-roller non-smokers than it drove away high-rollers
smokers. But as the article notes, this approach has to be marketed
aggressively. Why? Because smokers find out rather quickly that they
cant smoke on the grounds and many then dont return.
But the non-smokers staying at other casinos in the city likely have
no idea about Revels policy a marketing miss, because some
of those people would be more likely to stay at Revel (or at least visit
for shopping, drinking and dining).
yell: Bring back the smoke!
Boston.com (blog) - April 8, 2013
Last June, I talked to Revel CEO Kevin DeSanctis about the casino's
no-smoking policy. He said back then that smoke-free casinos are the
way of the future. ... More smoke in the air is good for Atlantic
Citys dry-cleaning industry, but Revels flip-flop does not
bode well for Massachusetts, where casinos by law will be smoke-free.
When the Bay States clean-air gambling palaces open in the next
few years, customers will still have the option of driving out-of-state
to casinos that permit smoking. Local gamblers already know the way
to Foxwoods. It will be an interesting experiment to see whether
people will drive an extra two hours to smoke, DeSanctis told
me last year. So what happens if gambling revenue in Massachusetts doesnt
live up to expectations? The smoking-ban would be an easy scapegoat.
Its not hard to imagine casino companies pressuring Massachusetts
lawmakers for relief, and threatening to cut jobs if they dont
Smoking will not be key to success at Revel Casino
NJ.com - April 6, 2013
To the Editor:
Revel Casino isnt the first business in New Jersey to go through
bankruptcy reorganization, and it wont be the last. However, it
may be the first business to think that its economic salvation lies
at the end of a cigarette butt. In its Chapter 11 bankruptcy filing,
Revel has revealed plans to allow smoking in its casino. Previously,
the casino had banned smoking. Revel is well within its legal rights
to add a smoking area; New Jerseys smoking restrictions for casinos
were written so that casinos can allow smoking on 25 percent of their
gaming floors. But Revel is wrong to think that allowing smoking will
bring in more business. If anything, it will drive away customers who
care about their health. And the State of New Jersey is wrong to allow
loopholes and exemptions in its smoking restrictions.

Individuals are divided over whether smoking bans in public parks cross
the line to trample on individual rights. The Rutherford Board of Health
has passed a resolution recommending that the governing body adopt an
ordinance designating all outdoor municipal public parks, recreation
areas and public events as 100 percent smoke and tobacco free.

the Fish at Revel Atlantic City is Revel itself
New York Business Journal March 22, 2013
While much of the local criticism of Revels operations
have focused on its blanket no-smoking policy, the Inquirer cited national
gaming experts who say that its more pressing problem is a lack of an
experienced casino operator running it, especially one with other properties.
That way, according to one expert the Inquirer quoted, an operator could
use a larger database and perhaps build complementary relationships
between Revel and other casinos.
expected to file Chapter 11 bankruptcy Monday
Philadelphia Inquirer - March 22, 2013
ATLANTIC CITY - Revel AC Inc., owner of the ailing, barely-a-year-old
Revel casino, is expected to file its Chapter 11 petition in U.S. Bankruptcy
Court in Camden on Monday, the start of what is expected to be a two-month
process to get its finances back on track. Revel will maintain normal
business operations during the bankruptcy. But the financial restructuring
appears to clear the way for a series of practical changes, including
addition of a smoking area, a beach bar, and more reasonably priced
restaurants, among other things, by Memorial Day weekend, in time for
the resort's peak season. Critics have contended the luxurious casino
overreached in trying to lure an upscale clientele to a largely drive-in,
middle-of-the-road Atlantic City market.
As the first fully nonsmoking
casino in Atlantic City, Revel has taken much heat. The stance on smoking
worked to Revel's detriment, since a majority of gamblers smoke, critics
say, and they have blamed it in part for dismal monthly casino revenues.
Too big, too empty, not enough staff, no buffet, no smoking,
a Bad Bet on the Boardwalk
Wall Street Journal March 21, 2013
The imposing casino, called Revel, opened a year ago but has
been a financial disaster.
Not even the biggest skeptics counted
on how poorly Revel would perform when it opened in April. Many insiders
blamed the casino's smoking ban. While Atlantic City law requires much
of the casino area to be nonsmoking, Revel is the only casino with a
complete smoking ban. Messrs. DeSanctis and Garrity resisted pleas from
investors to allow smoking, arguing that doing so could alienate customers
looking for a different type of resort experience, according to people
familiar with the matter. One investor says he sent the men emails imploring
them to "throw a party and have the Marlboro Man out front"
but they stuck with the ban. Recently, the men agreed to add an enclosed
smoking and gambling area, and say they are excited to start projects
using the Revel brand. The "investors had one time horizon, we
had another," Mr. DeSanctis says. Other observers say Revel's lessons
go beyond smoking. "More study needs to be done to find out why
gamblers aren't going there," says Brian Tyrrell, a professor at
Richard Stockton College who studied for Revel the possible effect of
the smoking ban. "It's a great concept."

The Hudson Reporter - March 15, 2013
NORTH BERGEN Mayor Nicholas Sacco and the Board of Commissioners
voted unanimously to adopt an ordinance banning smoking on public parks
and property Wednesday night at the town commissioners' meeting. Mayor
Sacco cited a concern for public health, especially that of the many
children who frequent North Bergens parks, as the driving factor
behind the decision. The dangerous effects of second hand smoke
on children are well known and we feel that protecting North Bergens
youngsters while they enjoy our beautiful parks is an important priority,
said Mayor Sacco. We are proud to adopt this ordinance and join
the growing list of smokefree communities in New Jersey. It is a law
whose time has come and we are always proud to make North Bergen even
more of a healthy, safe and progressive community.

In addition to the use of more traditional tobacco products, such as
cigars or cigarettes, the use of electronic smoking devices is also
banned, according to the ordinance.
of troubled Revel casino stepping down
New York Post - March 13, 2013
ATLANTIC CITY Kevin DeSanctis, the man who guided Atlantic City's
Revel casino-hotel through its tortuous development, only to see it
struggle in the cutthroat East Coast gambling market, is stepping down
as head of the $2.4 billion resort. The company announced Wednesday
that DeSanctis and chief investment officer Michael Garrity will resign
from their positions with Revel Atlantic City but retain their jobs
with Revel Group, the holding company that developed the resort and
licenses its brand. There, they will work on developing amenity projects
Asked what decisions he would change in retrospect,
DeSanctis said Revel needed more time to better integrate its 55 technology
systems. And the resort's non-smoking policy it is the only one
of Atlantic City's casinos to go totally smoke-free will be reviewed
in coming months, Hartmann said. "Probably we could have focused
a little more on how to make the smoking guests feel as welcome as the
non-smoking guest," DeSanctis said. "Our intention was never
to make the smoking guest feel uncomfortable."

Philadelphia Inquirer - February 21, 2013
ATLANTIC CITY - The plight of the lavishly expensive but bankruptcy-bound
Revel means more than just the future of one casino. It also means the
potential loss of a key ingredient in the desperate city's blueprint
Revel is Atlantic City's first fully non-smoking
casino. It has 10 swimming pools, 14 restaurants with celebrity chefs,
a retail gallery, two nightclubs, two theaters, lounges, and a spa and
was intended to bring in affluent overnight customers who liked to do
more than just gamble. "Revel's financial reorganization will set
the stage for them to more effectively compete in Atlantic City, where
there is enormous positive change," said Liza Cartmell, president
of the year-old Atlantic City Alliance, which is charged with rebranding
the resort by focusing on non-gambling activities.

Such was the consensus at the Township Committees Thursday meeting,
when Republican Mayor Mark Caliguire said the ordinance the committee
introduced at its previous meeting went beyond what he had intended.
The ban was unanimously introduced without comment at the committees
Oct. 7 meeting. But last week Mayor Caliguire said he had originally
intended the ban as a way to stop township employees who smoke from

into an ordinance.
As much as I hate smoking and I hate smoking in public places;
Im not sure if its something where we want to take the big
step of banning it completely, he said.

City voted us in to make these decisions. We're the ones who are going

Council members decided to schedule a public hearing to discuss the
issue after the Oct. 18 municipal elections. Mitrecic suggested forming
a committee in the meantime to consider its possible implementation.

information provided by the international organization GASP (Group Against
Smoke Pollution) and cited by DeRosa. The ban is a proactive attempt
to stop adults from setting a bad example and keep teenagers from starting
to smoke, she said.

If you ever lit up a cigarette at a county-owned park, pool or ball
field you won't be able to anymore.
The Union County Board of Chosen Freeholders has amended a no smoking
policy in county-owned buildings to include all county-owned recreational
areas and facilities. The facilities include ice-skating rinks, playgrounds,
running tracks, swimming pools, snack bars, ball fields, tennis courts,
boating areas (docks structures) and rest rooms which are located in
any county-owned recreational areas.
"Recreational areas are used by families with children and our
priority is to protect children from the effects of second-hand smoke,"
said Vice Chairman Deborah Scanlon. ...

Senate Approves E-Cigarette Restrictions
NJToday (CMD Media), 2009-12-11
The state Senate voted 38-0 Thurday to approve a bill to apply the
provisions of the New Jersey Smoke Free Air Act to restrict
the use of electronic smoking devices, commonly known as e-cigarettes.
The bill (S-3053) would expand the definition of smoking
to include e-cigarettes and extend the ban on smoking by minors to include
the use of e-cigarettes. It would define smoking as the burning or inhaling
of tobacco or any other matter than can be smoked or inhaled, or the
inhaling of smoke or vapor from an electronic smoking device.
When a user puffs on an e-cigarette, which is a stainless steel
tube designed to look like a real cigarette, they inhale a vaporized
solution that usually contains nicotine, Sen. Bob Gordon (D-Bergen)
said. The liquid often contains flavoring, such as chocolate or
cherry. It seems obvious the people who make these devices are trying
to make them attractive to younger people. ...
City will not consider full smoking ban in casinos for at least two

panic among casino executives concerned it would repel customers. ...
Assembly committee approves e-cigarette ban
NorthJersey.com, December 7, 2009
TRENTON -- Electronic cigarettes look like the real thing. And in New
Jersey, lawmakers want to treat them the same way.
That's why the Assembly voted unanimously Monday to ban the sale of
e-cigarettes to people under 19, and prohibit adults from smoking them
at work and in public places.
The Senate Health, Human Services and Senior Citizens Committee also
gave unanimous backing to the legislation.
E-cigarettes look like the actual cigarettes but don't contain tobacco.
A metal tube with a battery heats up a nicotine solution allowing smokers
to breathe in vapor. They have not been approved by the Food and Drug
Administration, which in July issued an advisory the devices contain
carcinogens and toxic chemicals such as diethylene glycol, an ingredient

Assemblywoman Connie Wagner (D-Bergen), a sponsor, said she's concerned
e-cigarettes are being marketed to children because they offer flavors
like chocolate, banana and strawberry and could serve as a gateway to
real cigarette use. ...

Councilman Wants To Play Copy Cat With Casino Smoking Ban
Casino Gambling Web - October 19, 2009
There is a bizarre stance being taken by Councilman Dennis Mason when
it comes to smoking in Atlantic City. Mason believes that AC casinos
should protect their residents from the dangers of second hand smoke,
but only if neighboring states take the initiative on the matter.
"I'll be happy to support a 100 percent smoking ban if and when
casinos in other states enact the same thing," said Mason, "All
we want to be on is equal footing."
So this is what the smoking issue has come down to in Atlantic City.
The gaming industry is so strong in the city, that Councilman Mason
openly admits that he has no real stance on the dangers of second-hand
smoke. The only issue Mason is concerned with is a financial one.
Mason, however, is not alone with his lunacy on the smoking issue.
The entire City Council is split on whether protecting patrons and workers
from second hand smoke is as important as the financial ramifications
should the casinos lose some customers.
Last year, the Council voted 5-4 to delay implementation of a smoking
ban in casinos and used the economy as their crutch for giving in to
the gaming industry. This year, however, the Council will not receive
a free pass from workers and AC residents more worried with their health
than the casinos' bottom line. ...

A year after Atlantic City delayed a total smoking ban at the request

But council members also promised then to revisit the issue in a year.

Officials target electronic smoking devices
Paramus is considering an indoor ban on electronic cigarettes.

"Smoke in taxis" flashes across a flat-screen television
at the unambiguously named Smoking Everywhere kiosks. "Smoke at
sporting events. Smoke at the movies. Smoke at the office."
To bring the message home, a salesman at Westfield Garden State Plaza
took a drag and blew three perfectly formed rings toward shoppers strolling
out of J.C. Penney.
According to the product's marketers, that substance may look like
cigarette smoke, but it's as harmless as water vapor. It's almost completely
odorless, they say, and it dissipates in seconds.
But some North Jersey health officials aren't convinced.
Buoyed by a recent Federal Drug Administration study that found electronic
cigarettes may contain carcinogens and toxic chemicals -- including
diethylene glycol, a substance found in antifreeze -- state and local
officials have issued warnings about using them or leaving them where
they can be reached by children.
Paramus health officials said they are alarmed by reports of people
using electronic cigarettes at Westfield Garden State Plaza and are
considering a ban on the use of e-cigarettes in indoor public places
or work environments, just like regular cigarettes. It would be one
of the first bans of its kind in the country.
"The safety of these things cannot be assured," said Paramus
Health Department Director John Hopper. "Our concern is the effect
to the non-smoking public who may be breathing the vapors of these things
-- because they do give off vapors -- in public places." . . .
Darnell White, who owns Smoking Everywhere franchises at the Westfield
Garden State Plaza and Palisades Center malls and sells electronic cigarettes
online at smokingeverywhere.biz, defended his company, saying it refuses
to sell to children under 18 and claiming the product keeps people from
smoking traditional cigarettes.
"Anything that gets people away from regular cigarettes is a plus
in my book," said White, himself a non-smoker. "At the end
of the day, this product has helped hundreds of people to stop smoking."
. . .
But smokeless cigarette distributors say the agency has overstepped
its authority. Smoking Everywhere sued the FDA in April after the agency
seized several of its shipments.
As for Paramus' possible smoking ban, White says he won't let it pass
without a fight.
"The name of the company is Smoking Everywhere," he said.
"Everywhere means the malls also."

SEASIDE HEIGHTS -- After nearly a year of considering options, the
borough this week unveiled no-smoking sections on the beaches.
The borough adopted an ordinance at the end of 2008 giving the council
the authority to designate no-smoking zones, Borough Administrator John
Camera said. In June, the council set rules that allow smokers to remain
in the 20 feet closest to the boardwalk, but the rest of the beach is
designated as nonsmoking.
"It seems like a pretty good compromise. We don't want to turn
anyone away," Camera said, adding that the governing body considered
many different options to balance the needs of smokers and nonsmokers.
"They have already received some concerns from residents that it's
not enough of an area, or it's not being enforced enough," he said.

DAVID M. HALBFINGER
New Jersey's campaign finance system may have restricted the flow of
big money into statewide elections and cut down on the abuses known
as pay to play, but determined donors and fund-raisers always seem to
find a loophole.
Indeed, newly available records show that big donors to the Democratic
and Republican Parties -- along with law firms, engineers and others
who do business with the state -- are sidestepping the state's contribution
limits and pay-to-play rules by giving to the parties' governors' associations,
which turn around and spend heavily in New Jersey.
Harry Pozycki, chairman of the Citizens' Campaign, a nonpartisan group
that is an advocate of the pay-to-play rules, said on Monday that the
two associations were providing "a huge back door for the evasion
of contribution limits." He added, "Following the money becomes
that much more difficult." . . .

who is challenging Mr. Corzine, has raised $90,000 from the National

Trenton ward councillor Doug Whitney, a self-confessed smoker, said
wording in the bylaw was too restrictive.

it would apply to all of Centennial Park, he said.

some to as small as 20 by 30 feet. Smokers will need to walk to the
designated areas every time they feel an urge to puff.

The state's dire economic situation was not as evident a year ago.
That might have been why Atlantic City council members voted unanimously
to ban smoking entirely in all resort casinos on April 23, 2008.
Since then, the tanking economy has given casino executives a strong
argument to delay the full ban. Smoking opponents had their brief day

their legislation, resort government balked. On Oct. 8, council voted
